Full Terms & Conditions – Weetabix Advantage Promotion (the “Promotion”)

Please read these terms and conditions carefully. These terms and conditions (“Terms”) apply to the “WEETABIX ADVANTAGE” promotion (the “Promotion”). You will be legally bound by these Terms from the time you submit an entry for the Promotion.  Please retain a copy for your information.

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. 

1. The promoter of the Promotion is Weetabix Ltd, Burton Latimer, Kettering, England, NN15 5JR (the “Promoter“).  If you have any queries about the Promotion or these Terms, then please contact the Promoter by sending an email to consumerservice@weetabix.com. This Promotion is open to residents of the United Kingdom (excluding the Channel Islands and the Isle of Man) aged 18 or over, excluding employees, contractors, representatives, agents, officers or directors of the Promoter, its parent companies,  subsidiaries, affiliates, marketing agencies, or to any of their immediate family members or persons living in the same household, whether or not related, professional Instagram or Facebook users, social media influencers or those who work in the food marketing or social influencer industry, or anyone else professionally connected with this Promotion. 
2. No purchase is necessary to enter the Promotion.
3. Internet access, a valid email address and mobile number are required.  
4. In entering the Promotion, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Promotion before awarding a prize. 
5. The Promotion opens at 09:00 on 22 May 2024 and closes at 23:59 on 05 June 2024 (the “Promotional Period”). 
6. To Enter: during the Promotional Period:
   1. Visit www.weetabix.co.uk/bix-by-bix ;
   2. Complete the online form providing your full name, email address, and mobile number; and
   3. Submit a story, of up to 200 words, explaining why you, your team, group or community deserves to win a Weetabix Advantage prize and how it would help you/them to achieve their goals. 

Please note – although this promotion may be seen on social media, the Promoter will only accept applications submitted via www.weetabix.co.uk/bix-by-bix 

7. Maximum of 1 entry is permitted per person throughout the Promotional Period.
8. The Prizes: 
   • x3 winners will each receive £1,000 and a 72 pack of Weetabix Original (The Weetabix Advantage Prize); and
   • x50 runners up will each receive one 72 pack of Weetabix Original (Runners Up Prize).
9. Winner Selection:
   1. The Weetabix Advantage Prize: on 06 June 2024 x3 winners will be randomly selected from all valid entries received by the Promoter during the Promotional Period by an independent verification service. 
   2. Runners Up Prize: on 06 June 2024 x50 runners up will be randomly selected from all remaining valid entries received by the Promoter during the Promotional Period by an independent verification service.
10. Winner Notification:
    1. The winners will be contacted via email within 2 weeks of the Promotion close date and will have 14 days immediately following to contact the Promoter as directed in the message to confirm details (name, email address, postal address and age) in order to claim their prize. If a winner does not respond within the 14 day period, the Promoter reserves the right to disqualify the entrant and award the prize to a replacement winner selected using the same methodology as above. Participants are encouraged to monitor their accounts during this time in case they are a winner. These Terms will apply to any replacement winner, but they may have less time to respond and claim the prize.
    2. Entrants who have not won a Prize will not be notified. 
11. Prize Acceptance:
    1. Once eligibility for a Prize is confirmed and the Prize is accepted by a winner, fulfilment of the Prizes will take place within 28 days of acceptance of the Prizes. Any delay will be communicated to the relevant winner. The Prizes will be fulfilled by either Weetabix or its agency partner. It is the responsibility of the winner to provide correct, up-to-date details when accepting a Prize.  The Promoter cannot be held responsible for Winners failing to supply accurate information which then affects Prize acceptance or fulfilment of their Prize.
12. The Promoter monitors responses to this Promotion, including on all of the social posts which are connected to the promotion.  If any submissions, comments made on the social posts about the Promotion, or any previous posts made by an entrant are, or could be regarded, as being disrespectful or contain anything which is likely to, or could cause offence or distress, then the Promoter reserves the right to disqualify that entrant from the Promotion. 
13. Provided no objection (made on lawful grounds) is received from the winners, a winners list containing the surname and county or region of residence of the winners and the prizes won will be made available by the Promoter 4 weeks after the close of the Promotion Period, for a period of 8 weeks, on receipt of a self-addressed pre-paid envelope received by the Promoter at Weetabix Ltd, Burton Latimer, Kettering, NN15 5JR. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting consumerservice@weetabix.com.  We may nevertheless disclose the information to the Advertising Standards Authority or the Advertising Standards Authority of Ireland if required to do so.
14. The Promoter may request that the winners participate in publicity arising from the Promotion. Participation is at each winner’s discretion and is not a condition of Prize Acceptance. The Promoter may, but is not obliged, to use the winner’s name and image in connection with such publicity, subject to the winner’s consent. The Promoter will be entitled to share story referenced at 6(c) above as part of its usual social media activities without reference to the personal identifiable information of the winners.
15. The Promoter seeks to run a fair and secure promotion to prevent abuse and cheating. If you enter in a way that is not consistent with these Terms, your entry will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
    1. Verify the eligibility of entrants and/or winners through multiple means by requesting such information it consider reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
    2. Disqualify entries that are not made directly by the individual entering the Promotion. 
    3. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
    4. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
    5. Disqualify entries beyond the maximum allowed (i.e. one per entrant), or those using techniques such as ‘script’, ‘brute force’, multiple SIM cards for text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
    6. Disqualify entrants who tamper with the entry process.
    7. Disqualify entries which, in some other way, do not meet the requirements of these Terms, the spirit of the Promotion or any instructions forming part of this Promotion’s requirements. 
    8. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion. The Promoter will endeavour to provide reasonable notice in the event of cancellation, modification or suspension of the Promotion, setting out the reason(s) for such. 
16. No cash or other alternative prize will be provided in whole or in part, except that in the event of circumstances outside of its control, the Promoter reserves the right to substitute a similar Prize of equal or greater value. 
17. Weetabix will not conduct fundraising activities on behalf of an entrant. 
18. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to www.weetabix.co.uk/bix-by-bix
19. The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law, in which case its liability is limited to the minimum allowable by law.  Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.
20. The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances beyond the reasonable control of the Promoter.
21. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion modify or suspend the Promotion or invalidate any affected entries/claims. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.
22. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent participation in the Promotion. 
23. All personal data supplied for this Promotion will be used as set out in the Promoter’s Promotion Privacy Notice, available at www.weetabix.co.uk/bix-by-bix-terms-conditions 
24. The Promoter’s decision is final with regard to all promotional matters and no correspondence will be entered into.
25. If any part/s of these Terms are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.
26. These Terms are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.

PROMOTION PRIVACY NOTICE

This Promotion Privacy Notice (“Notice“) is provided by Weetabix Limited (“we“, “us“,or “our“), whose registered office is Weetabix Mills, Burton Latimer, Kettering, Northamptonshire, NN15 5JR in our capacity as an organiser and promoter of the “CHANCE TO WIN £1000 WEETABIX ADVANTAGE” promotion (the “Promotion“). It applies to all individuals in the United Kingdom (UK) who participate or interact with us in relation to the Promotion.

We are a ‘controller’ for the purposes of applicable data protection laws, including the UK General Data Protection Regulation and the Data Protection Act 2018 (collectively the “Data Protection Laws“), which means that we are responsible for how we use your personal data. 

Scope

We understand that the security of your personal data is extremely important, and we are committed to respecting your privacy and safeguarding your personal data in accordance with Data Protection Laws. 

This Notice is a summary of what we do with your personal data in relation to this Promotion and you should read it together with our main Privacy Policy (which can be found at www.weetabix.co.uk/privacy-policy/ (the “Privacy Policy”). This Notice is supplemental to our Privacy Policy and contains more information about how we process your personal data if you participate in the Promotion. How we Collect Your Personal Data

We collect and process certain categories of personal information direct from you when you register to, and then, participate in the Promotion and, if you are successful, when you contact us.  

These categories of personal information include: your name, mobile number, email address and date of birth, together with personal data you provide to us when you contact us by telephone, email or post if you are successful (together the “Promotion Personal Data”).

How we Use Your Personal Data

We will use your Personal Data for the following purposes and legal bases:

• For marketing research and analytical purposes. • To respond to enquiries, complaints and/or requests by you in relation to the Promotion. • To publish and/or make available to the Advertising Standards Authority (for UK customers) and Advertising Standards Authority of Ireland (for Republic of Ireland customers) upon request.	This processing is necessary in pursuit of our legitimate interests in managing our business in a commercially prudent manner.

If you do not provide us with your Promotion Personal Data, you will not be able to register your entry and participate in the Promotion. 

Recipients of your Personal Data

We will share your Personal Data with external third party partners (such as FRANK AND HONEY CREATIVE our marketing partners) that process your Personal Data for this Promotion as part of the services (such as hosting and assisting with running and fulfilment of the Promotion) which they offer to us. We take all reasonable steps to ensure that such third parties process your data in accordance with Data Protection Laws, only use it in accordance with our contract with them and keep it secure. If you are selected as a winner of the Promotion, we (or one of our authorised third party partners) will ask you to provide us with more information. For example, you may be asked about your city, county or region of residence to fulfil the relevant Prize and because we are obliged to make the winner’s name and location (city or county) available to people requesting that information in accordance with the Promotion T&Cs and to comply with the requirements under the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (the “CAP Code“). As provided in the CAP Code, the winner can object to us publishing or making available the name or reduce the amount of information published or made available. Please note that this does not affect our obligation to provide the relevant information and the winning entry to the UK Advertising Standards Authority if required to do so. 

Data Retention

If you are not selected as a relevant Prize winner of the Promotion, we will retain your Personal Data for 6 months following the completion of delivery of the relevant Prize to the winners (or if there are any relevant complaints or issues relating to the Promotion and if later, promptly following the resolution of those complaints or issues). After this period has elapsed, your Personal Data will be deleted in accordance with our Privacy Policy.

If you are selected as a relevant Prize winner retain your Personal Data for 6 months after the completion of delivery of the relevant Prize to the winners and any related publicity activities (or if there are any relevant complaints or issues relating to the Promotion and if later, promptly following the resolution of those complaints or issues). After this period has elapsed your personal data will be deleted in accordance with our Privacy Policy. 

Transfers of Personal Data

We do not transfer your Personal Data outside the UK and the European Economic Area. Where we transfer your Personal Data to a UK organisation from the EEA, we rely on the European Commission’s adequacy decision in respect of the UK (available here).

Security and Storage of Personal Data

We strive to implement appropriate technical and organisational measures in order to protect your Personal Data against accidental or unlawful destruction, accidental loss or alteration, unauthorised disclosure or access and any other unlawful forms of processing. We aim to ensure that the level of security and the measures adopted to protect your Personal Data are appropriate for the risks presented by the nature and use of your Personal Data. We follow recognised industry practices for protecting our IT environment and physical facilities.

AUTOMATED DECISION-MAKING

Winners of the relevant Prizes will be selected using automated means, i.e. without human involvement in the decision-making process.

In certain circumstances, you have the right to request access to, rectification, or erasure of your personal data, or restriction of processing or to object to processing of your personal data, as well as the right to data portability.
